1Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Pistonara, a brand of The Nelson M Group LLC ("Pistonara," "we," "us"). They govern your use of pistonara.com and related services, among them email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If these Terms are not acceptable to you, do not use the Services.

2What Pistonara is, and is not

Pistonara is an information service. We publish general, plain-language data about how insurance works, how to read a policy, and what tends to affect insurance costs, and let visitors opt in to related updates. We never sell insurance, give quotes, rates, or price estimates, match people with agents or insurers, or refer people to providers, and we do not share your details with agents, insurers, or other partners.

• Decisions about your insurance are yours. Reading our content does not obligate you to do anything.
• Your own insurer or agent, not Pistonara, explains the terms, limits, exclusions, and costs of any policy, and is responsible for your coverage.
• Costs, coverage, and savings vary by person, plan, and location. We never guarantee that you will save any amount, qualify for any coverage or discount, or get any particular result.

3Eligibility

You must be at least 18 years old, located in the United States, and able to form a binding contract to use the Services. You may only submit information about yourself, or about another person who has authorized you to do so.

4Your information and accuracy

Accurate, current information is required, and you agree to update it as needed. Do not give us a mobile number unless it is yours or you are authorized to use it. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

5Communications and text-message consent

If you choose to opt in, you consent to being contacted by email and, if you tick the boxes that apply, by automated text messages as set out in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. 6Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join at 877-550-1409, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-550-1409.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

7Acceptable use

You agree not to: (a) submit false, misleading, or someone else's data; (b) use the Services for unlawful, fraudulent, or abusive reasons; (c) interfere with or disrupt the Services or attempt unauthorized access; (d) use bots or automated means to submit forms; (e) copy, scrape, or resell our content without permission; or (f) impersonate any person or entity. We may suspend or end your access if you do.

8Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example state insurance departments, consumer groups, or insurers) are run by third parties. We do not endorse any product, plan, or provider and are not responsible for the conduct, content, or results of third parties. Your relationship with an insurer or agent is between you and them.

9Intellectual property

The Services, among them the Pistonara name, logo, text, graphics, and design, are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial purposes. Photographs on the Site are used under their respective free-use licenses.

10Disclaimers

The services and all content are given "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We will not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered or delivered on time.

Pistonara does not supply insurance, legal, or financial advice, and makes no representation about any policy, coverage, price, savings amount, or claim outcome.

11Limitation of liability

To the fullest extent permitted by law, Pistonara and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, are not responsible for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or goodwill, resulting from or connected to your use of (or inability to use) the services, or any insurance decision you make or do not make. Our aggregate liability for any claim relating to the services will not be more than one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

12Indemnification

You shall indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel from all claims, damages, and expenses (such as sensible attorneys' fees) arising from violating these Terms, misusing the Services, or providing a phone number or other information without authorization.

13Disputes, governing law, and arbitration

Informal resolution first. Please let us know about any problem first, at [email protected] and give us 30 days to try to resolve it.

Binding arbitration. Except where a matter belongs in small claims or involves injunctive relief for intellectual-property misuse, you and Pistonara or The Nelson M Group LLC agree that any dispute arising out of or relating to these Terms or the Services will be decided by final, binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in your county of residence or by video or phone, as you pick. The arbitrator may award the same individual relief as a court, and judgment might be entered in any court of competent jurisdiction.

Class-action waiver. Where the law allows, you and Pistonara each agree that claims will be brought only individually, and not as a plaintiff or class member in a class, collective, or representative action.

Opt-out. You have 30 days after first accepting these Terms to opt out of arbitration, which you do by emailing [email protected] with "Arbitration Opt-Out" as the subject, and tell us your name and mobile number.

Governing law. The laws of the state where The Nelson M Group LLC has its principal place of business, together with the Federal Arbitration Act, govern these Terms, without regard to conflict-of-law rules. Subject to the arbitration clause, the state and federal courts in that state have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. Access may be suspended or terminated by us at our discretion, for example for violations of these Terms. Sections that by nature are intended to survive, including disclaimers, limitation of liability, indemnification, and disputes, remain in force after termination.

15Changes

Updates to these Terms will be posted with a new "Last updated" date. Using the Services after the effective date means accepting the updated Terms. If a change is material, we will notify you as required by law.

16General

This is the entire agreement between you and us on this subject: these Terms plus the Privacy Policy and SMS Terms. The remainder survives if any part is unenforceable; failing to enforce a provision does not waive it. You need our consent to assign these Terms, while we may assign them in a merger or a sale of the business.
